These terms and conditions explain the rights and responsibilities of the client and The Hay Handyman.

Estimates & Quotations

The Hay Handyman may provide clients with a written estimate or quotation, which will include sufficient detail for the completion of the works. If any clarification is required, please contact us so that we can provide it.

Extra works can be provided subject to written confirmation, including cost.

A contract with The Hay Handyman is an agreement by the client to have work undertaken based on a written estimate or quotation headed “Quote/Estimate”, submitted directly to the client on official The Hay Handyman letterhead.

Contract & Cooling Off Period

Once an estimate or quotation has been accepted, either verbally or in writing, and the client has paid their deposit if applied, a contract has been entered into and these terms will come into effect.

Estimates and quotes are valid for the period outlined on the documentation.

Once the client has entered into a contract with The Hay Handyman by paying their deposit, if applicable, they have a 14 day cooling off period should they wish to cancel the contract.

The client can cancel their contract within 14 days by phone or email.

Commencement, Completion & Delays

Any dates of commencement and completion of works are offered in good faith and are based on the position at the date of order. These are not guaranteed and may be subject to delay.

Delays may be caused by strikes, weather, accidents, government direction, force majeure, mechanical breakdowns, unavailability of materials and parts, or other causes beyond the Company’s control.

The Hay Handyman will make all reasonable endeavours to start and complete work by the dates given but will not accept liability for delay or any form of liquid damages for external works governed by atmospheric conditions beyond reasonable control.

Commencement of work is under the assumption of uninterrupted work for the duration of the contract and in accordance with planning permission where applicable.

Prices, Invoicing & Payments

All prices quoted are calculated on the basis of free access and unimpeded working during normal working hours, 9am – 5pm Monday to Friday, excluding bank holidays, unless otherwise agreed.

Please note that we may be on site until 6pm or on a Saturday. Prior agreement will be obtained from the client should this happen.

Most projects under £1,000.00 will be invoiced on successful completion of works and will be due 7 days from the date of invoice.

Projects in excess of £1,000.00 may be invoiced in stages, including a project invoice at commencement to cover part or full costs of materials and access equipment.

Interim invoices may be raised every 14 days to the value of works completed to date. This may include further material orders above the initial cost. These invoices will be due 7 days from the date of invoice.

Final invoices will be raised on successful completion of works and will be due 7 days from the invoice date.

The Hay Handyman may provide a payment plan prior to commencement of works. This will usually include a 5% deposit, staged payments and an end payment upon completion.

Deposits are used to secure booking dates, purchase materials and cover administration costs. Deposits are generally non-refundable except where required by law or where The Hay Handyman is unable to commence the agreed works.

Payments must be made in a timely manner or work progress may be impeded or ceased in the case of non-payment.

Payments can be made by cash, credit card or bank transfer. Bank transfer is the preferred method. All invoices include bank details for bank transfers.

Cheques presented without prior arrangement will be subject to an administration charge. Cheques processed in this manner will be subject to a £30 administration fee.

The Hay Handyman reserves the right to charge reasonable administration costs, statutory interest where applicable, and recover reasonable costs incurred in recovering unpaid invoices.

Client Responsibilities

It is the customer’s responsibility to arrange planning permission, building control and any utility changes, such as Welsh Water.

If planning permission is required for the work, The Hay Handyman may request to see proof that this has been agreed before beginning work.

The client is responsible for ensuring that the site is safe for The Hay Handyman and, if applicable, its subcontractors to carry out the works.

The site must contain no hazards or dangerous features which were not disclosed by the client or reasonably apparent to The Hay Handyman on inspection before proposals were issued.

Site Access & Working Conditions

All materials supplied by the client must be readily available on site without delay, on the exact date and time requested, to ensure commencement or continuation of works.

The Hay Handyman will agree all practical arrangements regarding working methods with the client to minimise disruption and allow work to be carried out efficiently.

Free access is required for delivery of building materials, plant, machinery, skips and similar items.

The means of entry and exit to the working area must, as far as reasonably practicable, be safe and without risks to health.

Access to welfare facilities, on-site parking and available on-site services such as mains electricity and water supply are to be used without charge for project and works-related activities only.

Waste, HIPPOBAGs & Waste Calculator

Where waste is placed into a HIPPOBAG, skip bag or similar waste container, the client is responsible for ensuring that all items placed into the bag are accepted waste items and comply with the waste provider’s current accepted waste guidance.

The Hay Handyman is not responsible for any rejected, prohibited, restricted or non-accepted item placed into a HIPPOBAG by the client or any third party. Any additional charges, refused collections, delays, removal costs or disposal issues caused by rejected waste items will remain the responsibility of the client.

Any waste calculator provided on our website is intended as a guide only. It is designed to help estimate approximate waste volume and suggest a suitable bag size, but it cannot guarantee that every item will be correctly identified, accepted or suitable for collection.

The waste calculator may produce inaccurate results due to spelling mistakes, incomplete descriptions, unusual wording, script limitations, missed matches, product changes or changes to the waste provider’s accepted waste rules.

If the calculator does not identify an item as restricted or rejected, this does not mean the item is accepted. For complete certainty, clients should always check the official HIPPOBAG accepted waste guide or contact HIPPO directly before placing any item in a bag, especially where there is any uncertainty or concern.

Materials, Scope Changes & Subcontractors

All used or removed materials on site remain the property of The Hay Handyman and will be disposed of accordingly.

The Hay Handyman reserves the right to adjust fees and the date of completion if the scope of works or associated proposals are altered after the works are commissioned.

The Hay Handyman may directly employ or subcontract labour to work on site. Each subcontractor takes full responsibility for their own third party liability.

The Hay Handyman will oversee all works to completion and takes full general and operational responsibility in the running of any contract agreed with the client.

The Hay Handyman cannot guarantee the quality, suitability or manufacturer warranty of client-supplied materials.

Insurance

The Hay Handyman has Public Liability Insurance and Employers’ Liability to the sum of £2,000,000.

All usual general building practices are covered within our insurance policy.

Data Protection

All client information is retained in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 and all personal and client details will remain confidential.

Guarantees

All clients will benefit from a full guarantee on workmanship for a period of 12 months.

Guarantees on materials run in accordance with manufacturer warranty periods where applicable.

Our guarantee covers all new work and new materials used in construction or repairs, but does not guarantee the integrity of any existing structures, materials or decorations.

Charges may apply for remedial work carried out beyond guarantee dates or to items not covered by our guarantee.

Decorations are signed off on completion and are not covered by guarantee. Plastering work is not covered by our guarantee.

Where damage is caused by other trades outside of our control, the client shall be liable for the cost of any repair or replacement.

What is not covered: misuse, accidental damage, lack of maintenance, movement of existing buildings, defects in existing structures.

Existing Structures, Plumbing & Protection

No responsibility is taken by The Hay Handyman for the presence of perished or rotten timber, or any other perished or rotten materials, in existing structures such as doors, windows and frames, whether detected or undetected at the time of contract.

We will not be held responsible for the suitability of an existing boiler’s ability to provide for additional plumbing works. If the existing boiler is found to be unsuitable, this will be discussed with the client and any parts required shall be supplied at trade cost.

If existing radiators have to be removed for any reason, such as plastering, we will not be held responsible for their effectiveness once replaced.

The Hay Handyman will endeavour to protect existing surfaces with dust sheets, loose plastic sheeting and care in working practice. However, responsibility for protection from damage of existing surfaces or fabrics remains with the client.

Additional protection can be arranged at a negotiated additional cost. Clients are strongly advised to move expensive or sentimental items before work commences.

If furniture must be moved to undertake work, The Hay Handyman will not be held responsible for breakages or stains that may occur. Clients should keep valuables and expensive items safe and secure for the duration of the works.

Discounts, Retentions & Project Photos

Prices are based on the understanding that no retentions are held unless previously arranged and authorised.

No main contractor or subcontractor discounts are given unless agreed and confirmed in writing.

We will endeavour to employ a helpful attitude at all times and will always attempt to bring the works to a satisfactory conclusion as soon as possible, taking into account weather conditions, pandemics, utility failures, supplier delays, specialist material availability and unforeseen circumstances.

The Hay Handyman takes pictures of the progress of projects and reserves the right to use these pictures in its portfolio, website and social media for marketing and information purposes.

Photographs will never knowingly identify occupants or disclose sensitive personal information without permission.

Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
